GUIDELINES FOR DELIVERY IMPORTS/EXPORTS FCLS/LCLS

DANGEROUS GOODS OF PORT KLANG AUTHORITY GROUP TWO

 

  1. All Group Two dangerous goods must be taken direct delivery ex-ship/direct loading failing which the Authority MAY IMPOSE IMMEDIATELY 2 FIREMEN ON STANDBY.

 

  1. All Import Dangerous Goods must be declared by the Master/ Owner or Agent / Box Operator before vessel arrival. A copy of the declaration shall be submitted to the Consignee, Forwarding Agents or Freight Forwarder.

 

  1. A Consignee, Forwarding Agent or Freight Forwarder upon receiving the Group Two declaration can request for Temporary Storage where this will be submitted before arrival of the vessel. The Name and Contact Number of the Consignee should be included in the request letter. Failure to request for Temporary Storage can result in Fireman Charges being raised against the Consignee, Forwarding Agent or Freight Forwarder.

 

  1. In the event that the Consignee and Forwarding Agent or Freight Forwarder cannot be traced before arrival of vessel, the Principal Shipping Agent and Box Operator can request for Temporary Storage for the Group Two Dangerous Goods. Failure to request for Temporary Storage can result in Fireman Charges being raised against the Principal Shipping Agent and Box Operator.

 

  1. If and when approval is given for Temporary Storage, clearance must be made within the stipulated time, failing which additional safety measures will be imposed by the Authority.

 

  1. Below are  the list of  Group Two Dangerous Goods  which  (IF APPROVED FOR  TEMPORARY  STORAGE) require  additional  safety measures, e.g. Fireman/Bomba on standby:

 

                                i)                        Class 1.4S (explosive)

 

Must have Police permit.

Must be cleared within 48 hour. failing which 2 firemen will be on standby.

 

                               ii)                        Class 2 (gases)

 

Flammable & Toxic. Must be cleared within 24 hours, failing which 2 firemen on standby.

  

                             iii)                        Class 3 (Flammable liquid)

 

Packing Group 1 – Strictly Direct Delivery Ex-Ship.

On a case to case basis, the Authority may allow Temporary Storage for 24 hours, failing which 2 firemen on standby.

Packing Group 2 and 3 - Must be cleared within 48 hours, failing which 2 firemen on standby.

 

                             iv)                        Class 4.1 (Flammable Solid)

 

Self reactive, desensitized explosive – strictly Direct Delivery Ex-Ship. On a case to case basis the Authority may allow Temporary Storage for 24 hours, failing which 2 firemen on standby.

Packing Group 2 and 3. Must be cleared within 48 hours, failing which 2 firemen on standby.

 

                              v)                        Class 4.2 (Spontaneously Combustible)

 

Packing Group 1 and Self-Heating substances - Strictly Direct Delivery Ex-Ship.

On a case to case basis, the Authority may allow Temporary Storage for 24 hours, failing which 2 firemen on standby.

Packing Group 2 and 3. Must be cleared within 48 hours, failing which 2 firemen on standby.

 

                             vi)                        Class 4.3 (Dangerous when wet)

 

Packing Group 1 – Strictly Direct Delivery Ex-Ship.

On a case to case basis, the Authority may allow Temporary Storage for 24 hours failing which 2 firemen on standby.

Packing Group 2 and 3. Must be cleared within 48 hours, failing which 2 firemen on standby.

 

                           vii)                        Class 5.1 (Oxidizing Substances)

 

Packing Group 1 -  Strictly Direct Delivery Ex-Ship.

On a case to case basis, the Authority may allow Temporary Storage for 24 hours failing which 2 firemen on standby.

Packing Group 2 and 3 . Must be cleared within 48 hours, failing which 2 fireman on standby.

 

                          viii)                        Class 5.2 (Organic Peroxide)

 

Strictly Direct Delivery Ex-Ship.

On a case to case basis, the Authority may allow Temporary Storage with Bomba/Firemen placed on standby immediately.

 

                             ix)                        Class 6. 1 (Toxic substances)

 

Packing Group 1 – Strictly Direct Delivery Ex-Ship.

On a case to case basis, the Authority may allow Temporary Storage for 24 hours failing which 2 firemen  on standby.

Packing Group 2 and 3 . Must be cleared within 48 hours, failing which 2 firemen  on standby.

 

                              x)                        Class 6.2 (Infectious Substances)

 

Must obtain permit from Ministry of Health.

Strictly Direct Delivery Ex-Ship.

 

                             xi)                        Class 7 (Radioactive)

 

Must have permit from Atomic Energy Licensing Board.

Strictly Direct Delivery Ex-Ship.

 

                           xii)                        Class 8 (Corrosive)

 

Packing Group 1 – Strictly Direct Delivery Ex-Ship.

On case to case basis, the Authority may allow Temporary Storage for 24 hours failing which 2 firemen on standby.

Packing Group 2 and 3. Must be cleared within 48 hours, failing which 2 firemen on standby.

 

                          xiii)                        Class 9 (Miscellaneous Dangerous Goods Substances)

 

With the exception of UN 2211, IMO: 9 (Polymeric Beads, Expandable evolving flammable vapour) the Authority on a case to case basis may approve for Temporary Storage.

 

                Note:  1)  For Packing Purposes, substances of all classes, other than classes

                                 1, 2, 5.2, 6.2 and 7 and the self-reactive substances of class 4.1, are

assigned to three packing groups in accordance with the degree of danger  presented by the substance. The packing groups have the following meanings:

                       

                                    Packing Group I     :   Substances presenting High Danger

                                    Packing Group II    :   Substances presenting Medium Danger

                                    Packing Group III   :   Substances presenting Low Danger.

 

2)      Temporary Storage of Dangerous Goods in the shed is subject to space availability. If no space is available in the shed, the Dangerous Goods will be on Ex-Box basis.

 

3)      Temporary Storage shall not be granted for substances which are “SHADED FROM RADIANT HEAT” “KEEP AS COOL AS REASONABLY PRACTICABLE” and “SHADED FROM DIRECT SUNLIGHT”.

 

 

 

 

 

 

 

PROCEDURES FOR  HANDLING DAMAGED DANGEROUS GOODS IN PORT AREA

 

 1.     Responsibilities of Licensed Operators

     a)    Upon discovery of Damaged Dangerous Goods at the Terminal, a responsible person (appointed by the shore-side employer or the master of a ship who is empowered to take all decisions relating to his specific task, having the necessary current knowledge and expertise for that purpose and where required is suitably certified or otherwise recognized by the regulatory Authority) is to take the following appropriate steps namely:-

 

     i.          To notify the Manager, Dangerous Goods Department, Port Klang Authority immediately.

 

     ii.         To notify the Shipping Agent/Box Operator / Forwarding Agent (for export) and LPK on the particulars of the damaged dangerous goods i.e. the name of the Vessel, the IMO Class, U.N. Number, Container Number, Proper Shipping Name, whether the cargo was meant for import, export or transhipment.

 

    iii.         To place fire engine on standby immediately

 

    iv.         To isolate the cargo if practicable.

 

    v.          To get Bomba Personnel to barricade the area and ensure  that there is at least 50 meters Safety Zone to prevent unauthorized personnel entering the area.

 

     b)    To get Bomba Personnel to break the container seal. The Bomba  Personnel prior breaking the seal are to take appropriate steps to determine the level of vapor concentration and other safety measures deemed necessary.

 

     c)    If the Shipping Agent/Box Operator or Forwarding Agent is not present at the breaking of the seal, the Licensed Operator may do so if the container needs to be ventilated.

 

     d)    To conduct an inquiry as soon as possible on the damaged dangerous goods and submit a report to the Authority within 7 working days.

 

 2.     Responsibilities of Shipping Agent/Box Operator (Slot Charter) and Forwarding Agent

     a)    In the case of import, the Shipping Agent/Box Operator is to contact the consignee to obtain expert technical advice on how to handle the damaged dangerous goods. The Safety Officer of the Company is required to be at the site to provide the advice.

 

     b)    In the case of export, the Forwarding Agent to contact the Shipper to obtain expert technical advice on how to handle the damaged dangerous goods. The Safety Officer of the Company is required to be at the site to provide the advice.

 

     c)    In the case of transhipment  damaged dangerous goods, the Shipping Agent/Box Operator to notify the Principal immediately and seek their assistance to contact the Shipper in order to obtain technical advice on how best to deal with the damaged dangerous goods.

 

     d)    To obtain the Material Safety Data Sheet from the Shipper and extend a copy to the Port Authority and Licensed Operator.

 

     e)    To engage the services of a contractor who has been appointed by the Port Authority and has the technical know-how, experience and equipment to handle the damaged dangerous goods. For information there are at present two contractors in Port Klang who have the technical know-how, experience and equipment to handle  damaged dangerous goods as follows:

     f)    To obtain approval from the Dangerous Goods Department, Port Klang Authority to appoint a contractor and also Free Zone Department if involves transloading activity.

 

     g)    The Shipping Agent/Box Operator/Forwarding Agent shall obtain the Container Packing Certificate (CPC) from the appointed contractor and submit to the Authority upon completion of stuffing.

 

     h)    Appointed Contractor must comply with the OSHA (Occupational Safety and Health Act) and Department of Environment regulations on chemical handling.

 

     i)    The Appointed Contractor must be registered with Kualiti Alam Sdn Bhd (to dispose the waste due to damage).

 

     j)    The Appointed Contractor to submit a report upon completion of work (handling damage) to the Port Authority within 7 working days.

 

Note

 

All matters pertaining to damaged dangerous goods must be resolved soonest (preferably within 24 hrs) failing which the Authority will enforce Article 123 (4) & (5) of the Dangerous Goods by-laws ( see attached appendix ) and all cost will be borne by the Shipping Agent (import and transhipment) and Forwarding Agent in the case of export.

APPENDIX 

 Article 123:

 

(4)  If the Authority is of the opinion that the presence of any dangerous goods in the port constitutes an unacceptable hazard, the Authority may order the removal of the goods or the removal of the package, freight container, portable tank or vehicle in which the goods are contained.

 

(5) Where the master or owner of a vessel fails to remove the dangerous goods which constitutes an unacceptable hazard, the Authority may take  such steps to hold, remove or otherwise dispose of such goods and the expenses of so doing shall be borne by the master or owner.

 

 

 

 
 

 

GUIDELINES FOR TRANSHIPMENT OF DANGEROUS GOODS

AT PORT KLANG.

 

 

General Rules on Transhipment of Dangerous Goods at Port Klang

 

1.     List of dangerous goods which are not approved for transshipment

a)      Class 1     - Explosives

b)      Class 2.3  - Toxic gases with subsidiary risk.

c)      Class 3     - Flammable Liquids (IMDG Code Packaging Group 1)                                    

d)      Class 4.1  - With subsidiary risk labels of Class 1

e)      Class 4.1  - IMDG Code Packaging Group 1  

f)        Class 4.1  - Self Reactive Substances

g)      Class 4.2  - Spontaneously Combustible (IMDG Code Packaging Group 1)

h)      Class 4.2  - Self Heating Substances

i)        Class 4.3  - Dangerous when wet (IMDG Code Packaging Group 1)

j)        Class 5.1  - Oxidizing Agent (IMDG Code Packaging Group 1)

k)      Class 5.2   - Organic Peroxide

l)        Class 6.1  - Toxic Substances (IMDG Code Packaging Group 1)

m)    Class 6.2  -  Infectious Substances

n)      Class 7     -   Radioactive Substances

o)      Class 8     -   Corrosive (IMDG Code Packaging Group 1)

 

2.     On a case to case basis with the exception of explosives, radioactive substances and organic peroxide dangerous goods listed in item 1 may be approved for transshipment within 24 hours subject to safety conditions imposed by the Authority. We  do not permit transshipment for substances which must be shaded from radiant heat, shaded from direct sun light and keep as cool as reasonably practicable, eg. Toluene Diisocyanate UN No. 2078 IMO Class: 6.1, Calcium Hypochlorite UN No. 2880 IMO Class: 5.1,  Cyanuric Chloride UN No. 2670 IMO Class : 8 and Azodicarbonamide UN No. 3242 IMO Class : 4.1 and Polymeric Beads Expandable UN No. 2211 IMO Class 9.

 

3.     This however does not prevent the shipping agent in bringing the dangerous goods in item 1 into the port area meant for other ports. In such cases, the cargo must be taken direct ex-ship. i.e. removed to bonded warehouses.

 

4.         To facilitate the transshipment of dangerous goods and to ensure the safety, it is advisable to make an advance inquiry to the Authority with the following details:

                                                              i)      UN No.

                                                             ii)      IMO Class

                                                           iii)      Packing Group

                                                           iv)      Quantity / Weight

                                                            v)      Loading Port

                                                           vi)      Final Destination Port

                                                         vii)      Period of transshipment

 

5.      For Dangerous goods meant for transshipment having the same UN No and IMO Class, there should be only one declaration made for such cargoes.

 

6.      In the event, the transshipment of dangerous goods is not connected as scheduled and is shut-out , the Authority must be informed within 48 hours or earlier and a fresh declaration should be made.

 

 

Note

The above transshipment procedures are not applicable for transshipment to Malaysian port and they must be connected within 48 hours or earlier. The Authority will impose additional safety measures if required on a case to case basis.

PROCEDURES FOR  EXPORT DANGEROUS GOODS CONTAINER VIA PORT KLANG

A.        RESPONSIBILITIES OF FORWARDING AGENT/SHIPPER/   MANUFACTURER

1.         All export dangerous goods shall be declared to Port Klang Authority 48 hours prior to vessel arrival and extend a copy of the declaration to the Master / Principal Shipping Agent.

2.         To pack the dangerous goods container as per the advice of responsible person.

3.         To submit a copy of the Container Packing Certificate (CPC) to Port Authority, Principal Shipping Agent / Master of the vessel and Port Operator prior to vessel arrival.

4.         To ensure that Container Packing Certificate (CPC) signed by the responsible (competent) person who is recognized by the Port Authority.

5.         To prepare Chemical Safety Data Sheet (CSDS) as per Occupational Safety and Health Act 1994 for every product.

 

B.        RESPONSIBILITIES OF MASTER / PRINCIPAL SHIPPING AGENT

1.         To request for Container Packing Certificate (CPC) and Chemical Safety Data Sheet (CSDS) from the Forwarding Agent / Shipper prior to loading.

2.         To ensure that Container Packing Certificate (CPC) signed by the responsible (competent) person who is recognized by the Port Authority.

3.         To ensure that export dangerous goods containers are declared to the Authority and a copy of the declaration submitted to the Master of the vessel / Principal Shipping Agent.

 

C.        RESPONSIBILITIES OF PORT OPERATORS

1.         To ensure that every declaration is accompanied by Container Packing Certificate.

2.         To ensure that Container Packing Certificate is signed by the responsible (competent) person who is recognized by the Port Authority when the container entering into the port.

3.         To ensure that placards are affixed on the container as per the Dangerous Goods Declaration Form and Container Packing Certificate.

4.         To notify Port Kalng Authority Dangerous Goods Department immediately if there is any non-compliance of this procedures detected.

D.        RESPONSIBILITIES OF ‘RESPONSIBLE PERSON’ WHO SIGNS THE CONTAINER PACKING CERTIFICATE (CPC)

1.         To obtain Chemical Safety Data Sheet (CSDS) and Dangerous Goods Declaration Form from the Shipper prior to packing of the dangerous goods container.

2.         To ensure that the container is packed and secured properly as per International Maritime Dangerous Goods (IMDG) Code and IMO/ILO/UN ECE Guidelines for Packing of CargoTransport Units (CTUs).

 

NOTE

1.         RESPONSIBLE (COMPETENT) PERSON / COMPANY THAT RECOGNIZED BY PORT KLANG AUTHORITY FOR SIGNING CONTAINER PACKING CERTIFICATE (CPC).

2.         Warehouse Operators / Traders / Consolidators / Forwarding Agents are not allowed to sign the ‘Container Packing Certificate’ (CPC).

3.         ‘CPC’ shall also be prepared for all dangerous goods container packed in the port area including transloading.

 
 

 

PROCEDURES FOR HANDLING OF TRANSHIPMENT OF AMMONIUM NITRATE IN CONTAINERS AT PORT KLANG (WEIGHT : 400-700 MT)

UN : 1942 IMO CLASS : 5.1

 

Responsibilities of Licensed Operator

 

 

1.                  Upon discharge of the Dangerous Goods container at the Terminal, a responsible person (appointed by the shore side employer or the master of the ship who is empowered to undertake all decisions  relating to his specific task, having the necessary current knowledge and expertise for that purpose and where required is suitably certified or otherwise recognized by the Regulatory Authority) is to confirm with the following appropriate steps namely :

 

a)      Prior to discharging the dangerous goods containers

 

                                             i.            To obtain Material Safety Data Sheet from the Shipper and to comply with all the safety and security measure stipulated in the document.

 

                                           ii.            Liaise with Shipping Agent to ensure the packaging of the dangerous goods meets the requirements of the IMDG Code.

 

                                          iii.            Any freight container goods ( please refer problems ) shall comply with the relevant provisions in the IMDG Code.

 

 

b)      During discharging and storing of dangerous goods containers

 

i.                     No smoking is permitted and ‘No Smoking’ signs should be displayed.

 

ii.                   To get Bomba personnel to barricade the area and maintained 100 metres safety zone and to prevent unauthorized personnel entering the area.

 

iii.                  To store the above containers in an isolated area away from the existing dangerous goods area.

 

iv.                 To place 2 fire personnel on standby to monitor the dangerous goods containers and ensure that there is no contact with reducing compounds and combustible substances (particularly liquid).e.g Bromates, Chlorates, Chlorites, Hypochlorites, Nitrites, Perchlorates, Permanganates and powdered metals.

v.                   To ensure there is no welding, burning, cutting or other operations involving the use of fire, open flame, spark or arc-producing equipment are carried out in the restricted area.

 

2.                  Transshipment of the dangerous goods containers which includes discharging and loading onto 2nd vessel should be done within 7 days.  

 

3.                  To comply with the OSHA (Occupational Safety and Health Act) and Depatment of the Environment regulations on chemical handling.    

 

 

Responsibilities of Master of the Vessel  

 

 

1.                  Smoking should not be allowed on board of the vessel and ‘No Smoking’ signs should be displayed.   

    

2.                  Bunkering or transferring of fuel is not allowed. 

 

3.                  To ensure there is no welding, burning, cutting or other operations involving the use of fire, open flame, spark or arc-producing equipment are carried out in the restricted area.

 

 

Note

 

If the total weight of Ammonium Nitrate stored in CY exceeds 700 MT, the whole bomba unit must be on standby instead of 2 fireman on standby.

APPENDIX 1 – HANDLING OF EXPLOSIVE KPA GROUP 1 AT WHARF

 

 

Besides complying with LPK Dangerous Goods by Laws (Amendment 1989) ; vessel / barge at wharf to discharge / load explosive group (1) cargo, is also required to comply with conditions stated below :

 

1.                  To discharge during daytime only.

 

2.                  Bomba (machine) on standby throughout the duration of discharging / loading.

 

3.                  To barricade the protected area where discharging / loading is in progress.

 

4.                  Security officers to control movement of vehicles and crowd.

 

5.                  No explosives should be discharged unless transport is on standby to receive it.

 

6.                  The area of the wharf where the explosive are being handled should be clearly marked out as protected area. The limit of the area should extend at least 50 metres from where the containers are stored.

 

7.                  Clear notices prohibiting smoking are clearly visible at all location. No source of ignition should be brought into or near to place where explosives are being handled. The wearing of shoes or boots with unprotected metal nails,heels or tips of any kind should be prohibited

 

8.                  Forwarding agent / consignee/ shipping agent haulier in charge of operation should introduce himself to the officer (berth operator) on duty.

 

9.                  Whilst explosive are being handled precaution are to be taken to prevent unauthorized access of handling area.

 

10.              During handling of explosive no radar transmitter should be used within 50 metres of the cargo handling area.

 

11.              Tug boat to be on standby at short notice.

 

 
 

 

APPENDIX 2 – CONDITIONS FOR KPA GROUP 1 CARGO ON TRANSIT TO COME ALONGSIDE WHARF

 

 

 

1.                  To comply with LPK Dangerous Goods By Laws.

 

2.                  No explosives to be discharged from the vessel.

 

3.                  Fire engine to be on standby throughout the operation. Fire fighting equipment is to be ready for immediate use.

 

4.                  Clear notices prohibiting smoking are clearly visible at all location.

 

5.                  No resources of ignitions should be brought into or near to a place where explosive are being stored.

 

6.                  The area of the wharf where the explosives are being handled should be clearly marked out as protected area. The limit of the area should extend at least 50 metres form where the containers are stored.

 

7.                  No shifting of explosives on board allowed.

 

8.                  No land and reshipped of explosives allowed.

 

9.                  Tug boat to be on standby at short notice.

 

 

 
 

 

APPENDIX 3 – HANDLING OF SOLID BULK CARGOES (AMMONIUM NITRATE)

 

 During loading and discharge, the following measure should be taken.

 

1.                  Smoking should not be allowed on deck and in cargo spaces. ‘NO SMOKING SIGN’ should be displayed on ship/berth. These precautions should be observed as long as the material is on board/berth.

 

2.                  Bunkering or pumping of fuel should not be allowed.

 

3.                  Bomba on standby.
